Critical Race Theory Template
I urge the Department of Education (Department) to reject the two proposed priorities for the American History and Civics Education programs.
The American History and Civics Education programs are intended to support efforts to improve the quality of American history, civics, and government education by educating students about the history and principles of the Constitution of the United States, including the Bill of Rights; and traditional American history. The proposed priorities would do neither.
Teachers should not use the goal of teaching “diversity of thought” as an excuse to teach students to view others through ethnic stereotypes, or that America is an irredeemably racist country. Curriculum should use instructional content that creates a shared sense of national identity, teaching that America belongs to all Americans, and that this nation and its progress is worth celebrating.
When followed to its logical conclusion, critical race theory is destructive and rejects the fundamental ideas on which our constitutional republic is based. Applying the philosophy would violate a multitude of American civil rights laws by treating people differently according to race. It should not be elevated in American classrooms.

The July 14th 2020 discussion and vote for "The Resolution to condemn racism and to advance equity and opportunity for black students, indigenous students, and students of color" can be seen here. It starts at 2:50:00, at this link https://ohiochannel.org/video/state-board-of-education-7-14-2020-part-2 This goes on for 3 hours, and we voted at about 11:00 pm. It's grueling.
The majority of that board, and the current board, approve and support Critical Race Theory within the purview of Equity. Five OBE members --Fowler-Arthur, Hagen, Hill, Kilgore, & McQuire - did not vote to approve Resolution 20.
Follows are the venues that you can submit your comments that will have impact:
Distribute your concerns (letter) to every member of the Ohio Board of Education - list attached, and encourage as many others as possible to do so as well.

- Submit as ‘Public Input’ – written public ‘document of record’ for the May (10 & 11) Board of Education meeting > send as PDF to [email protected] no later than May 9th (the Sunday evening before the monthly SBOE meeting) by 5pm.
- Register to speak during the ‘Public Participation’ segment of the agenda - May 11, usually afternoon, currently via Zoom > > [email protected] no later than May 9 (the Sunday evening before the monthly SBOE meeting) by 5pm. public-participation-form(ohio.gov)
- Write both the Ohio Board of Education President, Laura Kohler, and the Ohio Department of Education Superintendent, Paulo DeMaria, to express your expectations for the OBE & ODE representation/support for Ohio students.
- Make sure the Ohio legislators know your thoughts regarding the issue – House & Senate Education Committee member list attached.

Vaccine Mandate Employee Letter Example
No authorship claim or copyright asserted...this letter just came to me in a bottle, and I have no idea who might have penned it, nor can I possibly vouch for it, and what you fine folks do with it is entirely in your own hands, as the Gentlemen of the Bar remind me I can proffer no legal advice in the matter, and do not so here...
Dear Boss,
Compelling any employee to take any current Covid-19 vaccine violates federal and state law.
First, federal law prohibits any mandate of the Covid-19 vaccines as unlicensed, emergency-use-authorization-only vaccines. Subsection bbb-3(e)(1)(A)(ii)(III) of section 360 of Title 21 of the United States Code, otherwise known as the Emergency Use Authorization section of the Federal Food, Drug, and Cosmetic Act, demands that everyone give employees the "option to accept or refuse administration" of the Covid-19 vaccine. ( ... ) This right to refuse emergency, experimental vaccines, such as the Covid-19 vaccine, implements the internationally agreed legal requirement of Informed Consent established in the Nuremberg Code of 1947. ( http://www.cirp.org/library/ethics/nuremberg/ ). As the Nuremberg Code established, every person must "be able to exercise free power of choice, without the intervention of any element of force, fraud, deceit, duress, overreaching, or other ulterior form of constraint or coercion; and should have sufficient knowledge and comprehension of the elements of the subject matter involved as to enable him to make an understanding and enlightened decision" for any medical experimental drug, as the Covid-19 vaccine currently is. The Nuremberg Code prohibited even the military from requiring such experimental vaccines. (Doe #1 v. Rumsfeld, 297 F.Supp.2d 119 (D.D.C. 2003).
Secondly, demanding employees divulge their personal medical information invades their protected right to privacy, and discriminates against them based on their perceived medical status, in contravention of the Americans with Disabilities Act. (42 USC §12112(a).)
Third, conditioning continued employment upon participating in a medical experiment and demanding disclosure of private, personal medical information, may also create employer liability under other federal and state laws, including HIPAA, FMLA, and applicable state tort law principles, including torts prohibiting and proscribing invasions of privacy and battery. Indeed, any employer mandating a vaccine is liable to their employee for any adverse event suffered by that employee. ( https://www.osha.gov/coronavirus/faqs#vaccine ). The CDC records reports of the adverse events already reported to date concerning the current Covid-19 vaccine.( https://www.cdc.gov/coronavirus/2019-ncov/vaccines/safety/vaers.html )
